Legal Framework (*)
The law on mediation was first approved in the year 1999, and then restituted by the present law no. 9090, dated 26.06.2003 “On Mediation in Disputes Resolution” The law prescribes the area where mediation will be applied, that are: civil, family and penal areas.
This law pays special attention to the reconciliation agreement reached as result of mediation, providing legal power to it and considering it as an executive title, which has to be executed by the bailiff's office. The law prescribes also the relations among mediators and the justice bodies and prosecution office.
