Results of the Pilot projects in Banja Luka and Sarajevo

Until mid December, a total of 500 mediations were held at the Centre for Mediation in Banja Luka, of which 9 are still underway. Agreement was reached in 289 of them, which accounts for nearly 60% of the total number of completed mediations. These agreements have resulted in releasing of more than 17,6 million convertible marks blocked in lengthy civil procedures.
87 mediations were held at the Centre for Mediation in Sarajevo, of which 6 are still underway. Of the completed mediations, agreements were reached in 36, which accounts for 44% of the total mediations completed. Some 600 thousand convertible marks have been released.
The majority of the cases are commercial disputes followed by labour disputes.
The Centres for Mediation were opened by the International Financial Corporation - IFC (previously SEED), and the Association of Mediators in BiH, specifically in April 2004 in Banja Luka, and in May 2005 in Sarajevo. 

Association of Mediators in BiH published call for applications for Mediators’ Roster
November 15th 2006
The Association of Mediators in BiH published Call for Applications for registration in Mediators Roster in Bosnia and Herzegovina on November 14th 2006. Call is open to all interested members of the Association of Mediators in BiH who completed necessary training in mediation regulated by the Rule on Mediation Training (Official Gazette BiH, 21/06). Candidates need to fill the application form and submit the following documentation:

  1. Certificate of citizenship of BiH,
  2. CV including contact details (address, telephone), 2 photographs,
  3. Copy of the certificate of university degree,
  4. Certificates on completed mediation training,
  5. Certificate proving there are no criminal charges against the candidate,
  6. Proof of paid membership fee for the current year.

 

Candidates can deliver documents to the Association of Mediators offices in Sarajevo (st. Kaptol 5) and Banja Luka (st. Voždovačka 3) by regular mail or personally. The application form can be obtained in the offices or requested by e-mail: maja@umbih.co.ba

AMBiH developed the forms for mediation procedure
November 15th 2006
The Association of Mediators in BiH developed forms for mediation procedure that will be used from 2007 in full implementation of mediation Law. The forms are key element for transfer from the pilot phase into full service providing. They were developed in cooperation with consultancy of Canadian Institute for Conflict Resolution, which was supported by Canadian International Development Agency – Partnership for Tomorrow Programme.

Trainings for new mediators
November 15th 2006
During October and November the Association of Mediators in BiH organised two advanced trainings and one basic training for new mediators in Banja Luka and Sarajevo. Up to now there are more than 100 individuals who completed advanced programme of AMBiH and programme of other institutions recognised as advanced programme. The next trainings are scheduled for early 2007.

 

Mediation and Financial Institutions
November 8th 2006
Representatives of Association of Mediators in BiH, International Finance Corporation (IFC) and financial institutions from Serbia, Slovenia, United Kingdom and Bosnia and Herzegovina informed representatives of banks, leasing and insurance companies about benefits of mediation in disputes involving financial institutions. In the Round table organised in Sarajevo by IFC, they presented mediation laws and procedures, experience from practice and future plans of development of mediation in BiH.

 

Regional conference of the Southeast Europe mediation forum
November 1st 2006
In the organization of the Association of Mediators of Macedonia and under the auspices of the CSSP Project Centre from Berlin, a regional conference of the Southeast Europe Mediation Forum was held in Skopje from October 12th to 15th. It presented the development of mediation and models of application in the Southeast European countries, and the participants had an opportunity to attend workshops on court-based mediation, restorative justice, school and family mediation, and discussions on sustainable mediation and approach of attorneys to this form of dispute resolution. The future was discussed of the Forum as an informal network, as well as its structure, membership, and forthcoming steps in cooperation among the member countries. The Steering Board was selected consisting of eight members, and Ivana Gajovic from Montenegro was elected President. The network Coordinator is Smiljka Gavric from the Association of Mediators in BiH. The event was attended by 70 participants from Albania, Bosnia and Herzegovina, Montenegro, Croatia, Macedonia, Slovenia, Serbia, and Kosovo, and lecturers from Great Britain and Italy. The BiH team consisted of: Sesenam Cosic, member of the Management Board of the AMBiH, Smiljka Gavric, Coordinator of the Centre for Mediation in Sarajevo, Orleanka Nikodinovic, and Adnan Novo, mediators in the pilot projects in Banja Luka and Sarajevo.

IFC and CEDR: Mediation in practice
November 1st 2006
Organized by the International Finance Corporation (IFC) training sessions were held in October 2006 in Banja Luka and in Sarajevo titled "Mediation in Practice", with special focus on mediation in commercial disputes. The training was conducted by the trainers for the Centre for Effective Dispute Resolution (CEDR) from London, one of the leading organizations involved in alternative dispute resolution in Great Britain. The participants underwent practical exercises in commercial dispute mediation and shared experiences on the models and promotion of mediation in BiH and in Great Britain.

Advanced training courses for mediators
November 1st 2006
In June and October, the Association of Mediators in Bosnia and Herzegovina organized three advanced training sessions „Mediation 2 – Getting Ready to Mediate“. This training is the final requirement for entry into the Registry of mediations in terms of mediation training. The training required for entry into the registry of mediators was undergone by some 100 persons coming from various cities of Bosnia and Herzegovina. Mediation in family law
October 1st 2006
In September in Sarajevo, the Association of Mediators in BiH and the International Finance Corporation organized a Round Table titled "Mediation in Family Law". The conclusion was that there is a need to organize training in mediation for mediators in family cases that may be offered by the Association of Mediators in BiH. The representatives of the Association of Mediators in BiH spoke about mediation pursuant to the family law of the Federation of BiH, and about the Nordic model of family mediation. The event was attended by the representatives of foreign organizations and domestic institutions involved in this field.

 

Seminar – Recognizing a case for mediation procedure
September, 22nd 2006
In the organization of the Centres for Training of Judges and Prosecutors from the Federation of BiH and Republika Srpska, and of the Council of Europe, a seminar was held in September titled "Recognizing the Case for Mediation Procedure". The participants were judges from the courts across BiH, who need to transfer this knowledge to their courts in order to facilitate a more efficient selection of cases and allow access to mediation for parties in dispute.

 

Nordic conference on mediation

September 22nd 2006
Through a study visit to Norway and Finland, the representatives of associations involved in dispute resolution and mediation from the Western Balkans, including the representatives of the Association of Mediators in BiH, learned about the models of mediation application there, and took part at the Nordic Conference on Mediation. The participants underwent a series of workshops on court-based, family mediation, mediation in criminal cases, community-based mediation, and visited organizations and institutions offering mediation services. In Norway, mediation services are coordinated by the National Mediation Agency, offering mediation services in various areas through its subsidiaries and through projects with non-governmental organizations and institutions. The study trip was organized by the Nordic Mediation and Dispute Resolution Forum. The gathering of the organizations from the Balkans in Norway and Finland was an opportunity to start preparations for the Balkans conference on mediation held in Macedonia in October this year, and to share experiences and discuss further networking of these organizations.
